Bush describes his iPod experience

We don't usually catch Fox News*...but they got a few extra "innings" with the US leader...and what do we learn?

Prez Bush knowz iPods.  He says he has the Beatles on that iPod.  BTW, the Beatles aren't available on iTunes or any other download service.

We forget.  Is it legal to rip CDs and put them on your iPod?

According to the RIAA, Bush is breaking the law:

The industry's lawyer in the case, Ira Schwartz, argues in a brief filed earlier this month that the MP3 files Howell made on his computer from legally bought CDs are "unauthorized copies" of copyrighted recordings.

"I couldn't believe it when I read that," says Ray Beckerman, a New York lawyer who represents six clients who have been sued by the RIAA. "The basic principle in the law is that you have to distribute actual physical copies to be guilty of violating copyright. But recently, the industry has been going around saying that even a personal copy on your computer is a violation."

RIAA's hard-line position seems clear. Its Web site says: "If you make unauthorized copies of copyrighted music recordings, you're stealing. You're breaking the law and you could be held legally liable for thousands of dollars in damages."

They're not kidding. In October, after a trial in Minnesota -- the first time the industry has made its case before a federal jury -- Jammie Thomas was ordered to pay $220,000 to the big record companies. That's $9,250 for each of 24 songs she was accused of sharing online.

Whether customers may copy their CDs onto their computers -- an act at the very heart of the digital revolution -- has a murky legal foundation, the RIAA argues. The industry's own Web site says that making a personal copy of a CD that you bought legitimately may not be a legal right, but it "won't usually raise concerns," as long as you don't give away the music or lend it to anyone.

Of course, that's exactly what millions of people do every day. In a Los Angeles Times poll, 69 percent of teenagers surveyed said they thought it was legal to copy a CD they own and give it to a friend. The RIAA cites a study that found that more than half of current college students download music and movies illegally.

The Howell case was not the first time the industry has argued that making a personal copy from a legally purchased CD is illegal. At the Thomas trial in Minnesota, Sony BMG's chief of litigation, Jennifer Pariser, testified that "when an individual makes a copy of a song for himself, I suppose we can say he stole a song." Copying a song you bought is "a nice way of saying 'steals just one copy,' " she said.

But lawyers for consumers point to a series of court rulings over the last few decades that found no violation of copyright law in the use of VCRs and other devices to time-shift TV programs; that is, to make personal copies for the purpose of making portable a legally obtained recording.

He talks like my Uncle. My Uncle is handicap because of a really high fever he had when he was a child.

I wonder if he had a fever when he was a child. Or maybe he did coke and binge drank alcohol for 30 years. One of the 2.

BTW. How did he get the Beatles on there? They aren't sold digitally and according to the RIAA it is illegal to rip CDs?

His legal council advised him that it's OK for the President to do it as long as it's for combating terrorists. This is a clear case of national security as he's just keeping tabs on that bastard John Lennon. http://www.commondreams.org/views06/0910-25.htm

So, er, how were Apple

So, er, how were Apple supposing we put music on our iPods back when they 'invented' them, then? Did the iTunes Store exist back then?

I mean I know it's cool to bash Bush (and heaven knows he deserves it), but hasn't Beatles album covers appeared on iPod collections in Apple keynotes?

(could be wrong here)

Ah! Leave him alone! I bet you're breaking the law in some way or another.

Not Up to Date

It is legal to back up your music tracks on your own device. There are too many precedents to cite. The RIAA actually disavowed that comment as inaccurate.

Besides as President, he can pardon himself even if it was a violation.

Maybe he upgraded already

2830

Being that he's knows for using the INTERNETS quite well, he's probably upgraded to the iPod Touch by now. :-)

It's legal to rip your CDs in Canada. Maybe that's what he was doing in Ottawa a few years back. You know, when he wasn't being an ass and causing traffic jams.

Even if the RIAA could form its own defense in court claim prejudice, the president could always pardon himself. (Who knows what else he can do.)

Lots of bad information

2831

Lots of bad information here.

RIAA specifically states you can copy a CD as long as you don't give a copy to someone else (loan it or allow it to be copied).

There is no violation by taking the CDs that Bush owns and ripping them to his personal iPod. Nor does the RIAA say there is a problem.

The problem comes about when you copy a CD then give it to your friend.

The Beatles on the iPod

2331

It is completely legal to have The Beatles on the iPod. Just insert a CD and put anything you'd like into iTunes. Connect your iPod and by magic you have The Beatles on you iPod.
