Psystar sold around 768 computers with Mac OS X installed?

Zowch.  According to Computerworld, Mac Clone-maker, Psystar, never got close to its investor estimates of 70,000 – 130,000 machines for 2009.   Their estimates of millions and tens of millions for 2010 and 2011 respectively would then seem a little off the mark as well.

Under its conservative projections, Psystar told investors it would sell 70,000 computers in 2009, 470,000 systems in 2010 and 1.45 million machines in 2011. The firm’s aggressive growth model, however, put those numbers at 130,000, 1.87 million and 12 million during 2009, 2010 and 2011, respectively.

In fact, an economist hired by Apple found that it might not have even reached the 1,000 computer mark from April 2008- August 2009.

“Psystar produced incomplete financial records,” Dr. Matthew Lynde, who works as an economics consultant for Cornerstone Research, said in a declaration submitted to Alsup on Monday. After digging through invoices, purchase orders and other documents, Lynde was able to pinpoint only 768 sales of machines with Mac OS X pre-installed. “Psystar has not challenged my analysis of its financial records,” Lynde added.

Strangely, Psystar also thought that their litigation with Apple would insulate them from competition from other would-be cloners.

It looks like Amazon is going for the jugular this year on Apple products.  They are matching or besting their MacMall/MacConnection/Clubmac brethren on Apple’s MacBooks, Minis, MacBook Pros and now iPod touches -without rebate or shipping hassles or charging tax (in many states).

Today, Amazon.com offers the new, 3rd-generation Apple iPod touch 64GB MP3 Player, model no. MC011LL/A, for $364.99. With free shipping, that’s the lowest total price we could find by $6. The new iPod touch models are now 50% faster, with support for Open GL | ES version 2.0.

Also, the  32GB touch is $275 and the 8GB version is $179.

Of note, pay with your Discover Card and Amazon drops another $10.

Apple opens up iTunes LP/Extras formats for indie labels, developers, more

Apple has held good to its promise to open up the iTunes LP and iTunes Extras format to developers, which in this case inevitably includes smaller music labels and movie studios, publishing a range of documents explaining the format. An October report earlier claimed Apple was keeping the new formats for major labels only and that the company was charging $10,000 for each piece of material released in the format.

iPod nano radio tagging comes to the UK

Some may recall the introduction of the all-new, camera-carrying iPod nano and its hot new feature – radio tagging of tracks played on its built-in FM radio for future purchase through iTunes.

This sounded great, but UK users had no radio channel offering support for the neat new feature – until now: Today, Absolute Radio became the first radio station in Europe to launch iTunes Tagging on the iPod Nano.

The new service was announced on the channel this morning, and will launch in London only via the station’s 105.8FM service, via a deal with Unique Interactive and Jump2Go.

How it works: When users hear a song they like on Absolute Radio on 105.8FM in London, they can simply tag it and then preview and purchase that song when they next sync to iTunes.

Simon Cole, CEO of UBC (the big brand behind the radio channel) said, “The use of radio as a prompt to purchase for music has been a vision of ours for the last three years. I’m really pleased to see much of the work we have put into developing IP in this area coming to fruition in our work with Absolute.  

“We are confident that tagging technologies are certain to be central to the broadcast model of the future. We are well positioned to benefit from this development.”

Forget Flash! Microsoft is building Silverlight for iPhone

This one from BetaNews certainly caught us off guard.  If Apple is hesitant to let Flash come aboard the iPhone platform, they’d be insane to let Microsoft’s Silverlight aboard, right?

Interestingly, Apple and Microsoft have been working together, or at least communicating  on a iPhone port of Silverlight. 

“We did all the work…We just made sure Apple was comfortable with it.”

From the description of the concept, it doesn’t seem like Apple is actually changing much about the iPhone, nor the way it interacts with Web servers.  However, Microsoft, on their IIS servers is building a mechanism by which Silverlight video content, stored serverside, can be streamed along to the iPhone in a format that the iPhone can use.

In essence, they are just building a server-side workaround for video playback.  Much like Youtube videos, which show a link on the webpage then stream MP4 files to the iPhones video player.app  Microsoft User Experience Platform Manager Brian Goldfarb stated:

“We’re translating the content to support the MPEG2 v8 [decoder] format that the iPhone format; we’re moving it to their adaptive streaming format. So it’s the same IIS smooth streaming content, the same server, the same point of origin, but now I can get that content to play without any code changes, without any real work, on the iPhone. That’s the critical thing for our customers.”

While it might be easy just to blow this one off, we’d note that NetFlix is based on Silverlight and if what this Goldfarb character is saying is true, we could be mere months away from having a iPhone Netflix Mobile service.

Apple sues to stop 'knock off' MacBook power supplies

Apple is moving to stop third party firms from creating cheaper alternative adaptors for Macs, launching a lawsuit against one such vendor.  Third party adapters are being sold by bigger retailers like Amazon through 3rd party channels.

Apple on Monday filed a patent infringement lawsuit against Media Solutions Holdings. In the suit, the company says the other firm sells “various consumer electronic accessories at retail, including knock-off power adapters for use with genuine Apple portable computers,

Surveys: iPhone users pay for digital content, while Mac users are all individuals

iPhone users are happier to pay for digital content than the wider online population; while Mac users are more creative and individualistic, a pair of surveys released this morning claim.

Media law firm, Olswang, has its eye on the iPhone users which it highlights in its 2009 Convergence Survey, released today. It shows that the iPhone population is a new opportunity for media firms.

According to the research:

  • 58% of people would pay to access online a film just released in cinemas,
  • 52% would pay for access to a film that will not be on DVD for at least two months
  • 40% would pay to access a film which is already on DVD or pay-TV.

However, within the iPhone users demographic, those figures jump to 73%, 67% and 54% respectively.

  • 41 percent of iPhone users (as against 30 percent of the general online population) would already be willing to take out subscriptions to access their favourite TV shows.
  • 19% of iPhone users surveyed said they access on-demand TV on their handsets
  • 37% said they want to access on-demand TV on their iPhone in the future. 

The survey also shows 30% of people (42% of iPhone users) would pay for an online book; 32% (43% of iPhone users) would pay for an extract from a travel guide; and 29% (38%) would pay for a magazine.

Olswang surveyed over 1,000 adults and over 500 13-to-17-year-olds about their digital habits. John Enser, partner in its media, communications and technology team, said,

Apple updates: iPhoto, Final Cut Server

Apple has introduced updates to iPhoto (improving the face recognition feature), Final Cut Server and its Xsan server software.

The iPhoto update (v 8.1.1) addresses issues affecting face recognition performance and accuracy. It also resolves minor issues with book ordering and iPod touch support. This update is recommended for all users of iPhoto ’09.  It is available through Software Update or as a standalone installer here.

Final Cut Server 1.5.1 includes a range of improvements, as described in the tech support note these include:

  • Fixes possible slowdown in the check in and check out process.
  • Fixes status display in the Downloads & Uploads window.
  • Corrects aspect ratio on thumbnails for anamorphic clips.
  • Locked assets are now skipped in the archive process.
  • Fixes archiving and restore for bundle assets.
  • Improves reliability of adding and removing archive devices.
  • The release also contains a significant number of smaller stability fixes.

New iPhone/AT&T information offered by analyst

Stock Analyst Turley Miller offers some of his research as it refutes many of the claims made by analyst Brian Marshall (video) yesterday.  Among them:

  • AT&T’s subsidy for the iPhone is $400, not $450 as Marshall states.  Best Buy buys 16GB iPhones from Apple for $542, and sells it for $199 with a 24 month service contract. AT&T reimburses Best Buy $400.  Therefore, Best Buy’s margin is $57/iPhone.
  • That subsidy wouldn’t change if other carriers offered the iPhone as Marshal states.  Tim Cook stated at a earnings call that it hadn’t in other countries where they went from exclusive to multiple carriers that the subsidies didn’t change.
  • iPhone users represent about 14% of AT&T

iLingual app replaces your mouth with a multi-lingual iPhone mouth

Gizmodo points us to the iLingual app (avalable in French, German and Arabic).  This one is unique because instead of just giving you a translation, it speaks the words with a mouth that may or may not resemble your own.  You can put that mouth in front of yours and everyone except Inspector Clouseau will think you are a local.  Nevermind.  Just watch the video, below.

Live Nation and iTunes launch exclusive live music program

iTunes continues to move toward presenting us with immediate musical experiences, this morning announcing a deal with Live Nation under which live gig recordings from venues across the USA will be offered exclusively for sale through the Apple music service.

Distorted Loop reports the scheme will see Live Nation Studios offering exclusive recorded and filmed concerts from its network of “wired” venues for purchase and download only on iTunes.

Exclusive live recordings from OK Go, Jesse McCartney, Saving Abel, A Fine Frenzy, Duffy, Plain White T’s and Ziggy Marley, have been released this week, with many more to follow.

“We are thrilled to offer artists a new high-quality platform to share the magic of their live shows with their fans,” said Michael Rapino, President and Chief Executive Officer of Live Nation.

Live Nation, through its Studios division, regularly records concerts in more than 80 of its venues, which have been transformed into next-generation “wired” live recording studios, and will now offer a variety of them for purchase and download exclusively on iTunes.

To coincide with the program’s launch, iTunes has added a new area dedicated exclusively to live recordings, the report adds (link leads to sample recording).

Seinfeld upgrades Macs, George builds iPhone App (Video)

Seinfeld, the iconic show about nothing is back as a show-within-a-show on Curb your Enthusiasm this season.  We last saw Jerry Seinfeld and Bill Gates co-host those strange Windows ads but it now appears he’s gone completely over to the Apple side.

He’s upgraded his Mac to a new iMac from the old Classic he used to use (wow, it has been awhile!).  Update: That is an iPod Nano in the stereo dock as well (Thanks commenter)

In the office, he uses a MacBook Pro, natch.

And George got rich making iToilet, the iPhone app that used GPS to find the nearest clean toilet…before he lost it all to Madoff.  Video Below.
