Notification abuse, too, led to AppGratis’s push out of the App Store

This past weekend, popular application discover app AppGratis was removed from Apple’s App Store. Many had correctly assumed that the application was pulled from the store because of Apple’s Developer Guidelines 2.25 clause:

2.25 Apps that display Apps other than your own for purchase or promotion in a manner similar to or confusing with the App Store will be rejected.

Any app that functions too similar to Apple’s own App Store, even if it routes users to complete the download via the App Store, will be rejected. If they already exist on the store, they will be removed. This Apple policy became stringent following the release of iOS 6 last fall.

While the app was removed for breaking this policy, AllThingsD reports that Apple has confirmed that the app was also removed for abusing Apple’s push notification system.

5.6 Apps cannot use Push Notifications to send advertising, promotions, or direct marketing of any kind.

Discovery apps that utilize a different, non-promotional business model seem to be safe.

comScore: Apple increases lead as top smartphone vendor in US, iOS steals market share from Android

Research firm comScore is out with its usual monthly report that ranks the top smartphone OEMs and platforms for the three-month period ending in February. Apple continues to grow its lead this month as top OEM in the U.S., jumping 3.9-percent from November to 38.9-percent of the market and increasing its lead on the second biggest OEM by subscribers, Samsung:

Samsung ranked second with 21.3 percent market share (up 1 percentage point), followed by HTC with 9.3 percent share, Motorola with 8.4 percent and LG with 6.8 percent.

Feb-Comscore-Apple-PlatformsIt’s important to point out that the shipped vs. sold argument doesn’t apply to comScore’s results, as its data comes from surveys tracking smartphone subscribers and usage and not sales or units shipped. Google grabs the spot as top smartphone platform at the end of February, but Apple continues to close the gap capturing 38.9-percent of the market (up from 35 percent) compared to Google’s 51.7-percent (down from 53.7-percent):

Court again rejects Apple’s attempt at Samsung Galaxy Nexus sales ban

Reuters reported today that a U.S. Federal Circuit Court of Appeals in Washington rejected Apple’s attempt to get a sales ban on Samsung’s Galaxy Nexus. Apple asked the court to revisit a previous decision to reject the company’s request for the sales ban leading up to a full trial set for March 2014. The case involved patents not included in the California trial that awarded Apple a $1.05 billion verdict against Samsung.

Apple wanted the full Federal Circuit of Appeals, made up of nine active judges, to reverse the earlier ruling. But in a brief order on Thursday, the court rejected Apple’s request without detailed explanation or any published dissents… Several experts had believed that Apple faced long odds, as the legal issues in play were not considered controversial enough to spur full court review.

Reuters noted that Apple could still appeal the decision to the U.S. Supreme Court:

Apple could still appeal to the U.S. Supreme Court. However, the high court has made it more difficult for patent plaintiffs to secure sales injunctions in recent years.

Best Buy selling almost as many iPhones as Apple… with four times as many stores

A new report from AllThingsD citied a study from Consumer Intelligence Research Partners that gives a breakdown of iPhone percentages sold through each retailer, including Apple and the carriers. The survey targeted iPhone buyers over a three-month period from December 2011 to February 2012 and found approximately 76 percent of iPhones were sold through brick-and-mortar stores. The other 24 percent of iPhones were purchased online. Those numbers obviously shift with a high number of preorders during product launches. The report noted the iPhone 4S’ s launch saw 67 percent sales conducted online, while only 33 percent were in-store.

The full breakdown for each retailer (in the United States) not surprisingly shows the carriers clearly dominate iPhone sales: AT&T captured 32 percent, Verizon came in at 30 percent, and Sprint with 7 percent. AllThingsD said Best Buy came out on top among retailers—other than Apple and the carriers—with 13 percent of sales compared to Apple’s 15 percent. Reports are quick to mention Best Buy is selling almost as many iPhones as Apple, but it is worth noting Best Buy has four times as many stores…

Apple advertises Boxing Week iTunes sale in Canada, 69-cent songs and albums from $5.99

Apple does not often have or advertise sales on Boxing Day, a holiday recognized in the United Kingdom, Canada, Australia, and New Zealand. On the holiday, retailers discount products similar to Black Friday in the United States. However, this year, Canadians are getting a Boxing Week sale on iTunes.

As of right now, Apple is running a promotion in at least the Canadian iTunes store with a selection of 69-cent songs and albums from $5.99, including: Mylo Xyloto by Coldplay, Scary Monsters and Nice Sprites by Skrillex, Foo Fighters’ Wasting Light, and Take Care (Deluxe Version) by Drake.  Each album is selling between $5.99 and $7.99. Altogether, there are 30 or more albums offered.

There is also a selection of 69-cent song collections consisting of the top-selling songs from 2011, best songs of 2011, classic hits, and more.

It is unclear whether Apple will have a Boxing Day or Week sale in its Canadian, U.K., or Australian online and retail stores. Canadian retailers typically run Boxing Week sales from Dec. 24 through Jan. 2, but Boxing Day is traditionally recognized on Dec. 26. It appears the iTunes sale has not popped up in the U.K. or Australian stores, but let us know in the comments if it does.

With just two weeks of sales, iPhone 4S steals Android market share in the UK as iOS becomes bestselling smartphone platform in October

A recent survey conducted by GoodMobilePhones.co.uk of 1,694 Brits aged 18 and over made waves with claims that as much as 22 percent of U.K.  owners regret the purchase of iPhone 4S over battery life and jealousy of rival smartphones. What happened instead, research firm Kantar Worldpanel ComTech claims, was that the device went on to steal Android market share in the United Kingdom.

According to the findings of the research note, Apple’s U.K. handset market share in the quarter leading up to the end of  October climbed to 27.8 percent, a 2.8 percentage point increase, while Android dropped from 49.9 percent to 46 percent. Looking only at October sales, Apple won a cool 42.8 percent of all handset sales during the month versus 35 percent  of October sales for Android phones…

Grand-opening of the flagship Hong Kong Apple Store at IFC Center (Video roundup)

Apple’s flagship Store in Hong Kong just opened in the IFC Center this morning (Hong Kong time). The new Store certainly seems like a pretty big deal to the locals who’ve been lined up for days.
