Vudu avoids Apple’s revenue sharing model with iPad compatible web app

Walmart has just announced their Vudu movie streaming service is now available to iPad users via a web app (opposed to an iOS app), which effectively allows the company to go behind Apple’s back rather than partake in their App Store revenue sharing model. The app also works on other iOS devices, but hasn’t yet been optimized for the smaller screen. They’ve also announced their iTunes competitor, mp3.walmart.com, will be closing indefinitely starting August 28, 2011. However, the announcement notes the Walmart Soundcheck music streaming service will remain available, making us wonder if they have plans on implementing an iPad-specific version much like they’ve done with Vudu…

This isn’t the first time we’ve seen content providers trying to avoid sharing profits with Apple. In fact, just yesterday we told you about the new Kindle Cloud Reader app that is accessible via the web, much the same as Vudu. While not sharing revenue is an obvious benefit of bypassing the App Store, TechCrunch points out there are many other advantages as well.

For instance, by avoiding the App Store’s restrictions, Vudu will be able to push out new updates whenever they see fit, rather than having to wait for Apple’s approval. It seems like more and more developers have been pushed away from the traditional iOS app model due to stringent approval policies and the unpredictability of Apple’s ever-changing process.

The real question is.. do these web apps compare to the experience offered by native apps?

Apple turns to Samsung amid iPad 2 display issues with LG

Digitimes is reporting Apple has turned to manufacturers other than LG Display (specifically Samsung and Chimei Innolux) due to issues with the 9.7-inch panel they’ve been producing for the iPad 2. Apparently LGD was not only unable to meet its July orders by approximately 1 million units, but also failed to meet Apple’s requirements in impact tests.

Due to the manufacturing issues with LGD, Digitimes reports they have now turned to alternate supplier (and rivals in the tablet market) Samsung. However, this may be only a temporary solution to the supply problems, as the report is quick to point out Samsung is directly competing with the iPad 2 with their Galaxy Tab 10.1 (the same device Apple just received a preliminary injunction for to halt sales in the EU).

According to the report:

“Samsung’s Galaxy Tab has head-on competition with the Apple iPad 2 in the end market. This would prevent Apple from sourcing more panels from Samsung.”

This might be an indication that Apple is focused on transitioning away from Android-related manufactures, if for no other reason, simply to avoid having to rely on their competition to supply vital components. Doesn’t look like LG’s  $500 million display deal with Apple will be getting extended anytime soon, and a recent lawsuit launched against Apple (linked back to LG) certainly doesn’t help either.

Updated: Samsung Responds… Apple stops Samsung Galaxy Tab 10.1 distribution in European Union

Update: Samsung has issued the following statement (via TNW) addressing the court’s decision to grant Apple the preliminary injunction:

Samsung is disappointed with the court’s decision and we intend to act immediately to defend our intellectual property rights through the ongoing legal proceedings in Germany and will continue to actively defend these rights throughout the world.

The request for injunction was filed with no notice to Samsung, and the order was issued without any hearing or presentation of evidence from Samsung.

We will take all necessary measures to ensure Samsung’s innovative mobile communications devices are available to customers in Europe and around the world.

This decision by the court in Germany in no way influences other legal proceedings filed with the courts in Europe and elsewhere.

Reports are coming in that Apple has been granted a preliminary injunction for the entire European Union (excluding Netherlands) that will halt distribution of Samsung’s Galaxy Tab 10.1. This comes on the heels of a postponed launch of the device in Australia due to a lawsuit with Apple.

The decision by the Regional Court of Dusseldorf in Germany to block sales of the device comes after a judge sided with Apple on claims that Galaxy Tab copied key design components related to the iPad 2. While Samsung can appeal the court’s decision sometime in the next month, the Telegraph’s Shane Richmond is quick to point out it would be heard by the same judge. Apple is also said to have a separate lawsuit filed in the Netherlands as well.

Samsung had this to say in a recent statement about their legal disputes with Apple:

“Samsung believes that there is no legal basis for this assertion. We will continue to serve our customers and distributors and the sale of Samsung products will be continued.”

And Apple has made their stance on the situation clear…

“It’s no coincidence that Samsung’s latest products look a lot like the iPhone and iPad, from the shape of the hardware to the user interface and even the packaging. This kind of blatant copying is wrong, and we need to protect Apple’s intellectual property when companies steal our ideas.”

Apple granted iOS related patents for displays and voicemail

Today the US Patent and Trademark Office posted 20 new patents granted to Apple Inc, two of which are valuable patents related to the iPhone, iPad, and iOS. Patents like these have been becoming more important as mobile device manufacturers take each other to court.

According a report from Patently Apple, the three most noteworthy of the patents include one for integrated touch screen technology that allows the display to be “thinner, brighter and require less power” and require less parts to manufacture, another is related to the “Voicemail Manager” for iPhone, and the last appears to be related to “improved installation, retention and removal of hardware components” in Mac Pro or other tower-like personal computers.

Perhaps the most notable of the three is the “Integrated Touch Screen” patent. Below is a snippet of Apple’s summary from Patently Apple.

Apple’s Summary: The patent relates to touch sensing circuitry integrated into the display pixel stackup (i.e., the stacked material layers forming the display pixels) of a display, such as an LCD display. Circuit elements in the display pixel stackups could be grouped together to form touch sensing circuitry that senses a touch on or near the display. Touch sensing circuitry could include, for example, touch signal lines, such as drive lines and sense lines, grounding regions, and other circuitry.

Quark gets acquired by mergers and acquisitions firm, Apple could benefit

Remember Quark? The developer of popular publishing software QuarkXPress has been sold to merger and acquisition firm Platinum Equity, and, according to a report from Techcrunch, the company is already focusing on finding a new home for the Quark’s IP. In the midst of heated patent battles between smartphone makers, what might the patents and technologies owned by Quark have to offer Apple?

Magazine and newspaper subscriptions are a big focus for Apple, it’s clear with the introduction of Newsstand in iOS 5, an app dedicated to helping manage digital subscriptions. Quark recently launched their QuarkXPress 9 publishing software that will allow publications to “design for and publish to digital devices in a variety of formats”, specifically the iPad, “without requiring the services of a programmer.”

Apple has helped Quark in the past, offering their services to get the publishing platform working on Mac OSX.

The majority of large publications have millions in funding behind them when creating the digital version of their magazines for the iPad. However, if Apple were to integrate Quark software into an SDK specifically for publishers, the subscriptions market on iOS devices might closer resemble the ecosystem currently in place for games. In other words, giving developers without millions in funding the “tools to convert existing layouts to rich, interactive content — or create new iPad content from scratch” may bring with it a rush of quality content with subscription models much more attractive to users than those offered by the larger publications.

Apple is clearly making digital subscriptions a focus in iOS 5 with Newsstand Kit, which provides the ability update issues in the background and auto-update subscriptions, but the SDK certainly falls short of everything Quark software could offer publishers.

Google Plus updated with iPad and iPod touch support, (not yet universal)

Google has just pushed an update for the official Google+ app for iOS, bringing with it support for iPad and iPod touch, two devices the app was previously unavailable for, among a few other features including aggregated circle add notifications, huddle settings, and the usual “Performance and stability improvements”.

Unfortunately, this iPad support is not completely native as the app will just be a pixel-doubled iPhone application. This choice by Google is still better than no iPad support at all, though. You should be able to update the app now via the App Store or swing by iTunes and grab the new version now. We’ll keep you posted with any other discoveries we might make in this latest update.

Skype launches HD video calls for Mac OS X Lion with 5.3 update

Today Skype announced the 5.3 update for Mac OS X which brings HD video calls to Lion among a handful of other UI enhancements and bug fixes. The official Skype blog explains:

With Skype 5.3 for Mac OS X, you’ll also be able to send and receive HD quality video when talking to your friends and family. You’ll need to use the Mac’s built-in webcam or choose from a variety of webcams from our Skype Shop, such as the Logitech C910, to make video calls in crystal clear HD quality. To receive clear HD video calls on your Mac, we recommend an upload/download speed of 1.5Mbps.

While previous versions of Skype, even 2.8, seem to run rather well on Lion, official support should iron out any bugs you’ve been noticing since upgrading. The new update is not only available for Lion users, however, Skype’s blog post notes it is also compatible back to Leopard.

Apple to take global “portable computers” share for the remainder of 2011

The eye-popping chart above (via Fortune) shows Apple is on course to take control of global market share for portable computers (laptops, notebooks, and tablets) in the second quarter of 2011 – but that’s only as some analysts switch to accounting iPads as computers. Deutshe Bank’s Chris Whitmore, author of the chart, describes his findings:

Within the computing market, we see significant opportunity for Apple to take meaningful share in the second half as the Microsoft / PC ecosystem is relatively stagnant, lacking meaningful new offerings.

Many will be quick to point out the spike is due to taking iPad sales into consideration, a device that many analysts debate shouldn’t be considered as a competitor to notebooks and other portable PCs. However, Apple is steadily gaining ground on Dell, Hewlett-Packard, and Microsoft even without the iPad. Whitmore explains:

On the other hand, Apple will be competing with an upgraded Mac OS, new MacBook Airs (and other forthcoming Macs) and a new iPad iOS. Within the Tablet market, the iPad remains the Gold Standard as competitors struggle for mindshare and traction (note HP’s price cuts on the TouchPad). Meanwhile, competing PC manufacturers have suggested Ultrabooks won’t ramp in material volumes until 2012 due to challenges driving price points meaningfully below Apple’s Air. As such, Apple appears particularly well positioned for more share gains heading into the back-to- school and holiday selling season.

Apple’s “iTunes Replay” service, Netflix-killer unlikely anytime soon

Looks like we’re going to have to keep waiting for an Netflix-killer from Apple… Rumors were floating around last week that claimed Apple was on the verge of launching a new “iTunes Replay” service, which would allow users to re-download and/or stream TV shows and movies. Unfortunately, a new report from CNET claims Apple does not have the agreements in place to offer content from the big film studios via the cloud.

While we all know Apple is working on some type of on-demand service for iTunes content via iCloud, apparently sources have confirmed the company has failed to sign the majority of the six major film studios and “negotiations could drag on for months” before they eventually acquire cloud streaming rights.

There were also rumors that Apple could introduce a video subscription streaming service to rival Netflix and Amazon. However, the report confirms this was probably just speculation, most likely stemming from discussions Apple has had with studios regarding a video-on-demand service in the past.

Why is Apple having trouble signing the studios? Greg Sandoval from CNET claims HBO’s exclusive distribution rights with Warner Bros, 20th Century Fox, and Universal, as well as support for the new UltraViolet streaming service may be preventing Apple from landing deals with the big studios.
