German judge upholds ban on Apple push email, Apple must pay damages to Motorola Mobility

Apple suffered a significant blow in the ongoing patent battles with Android competitors today when a Mannheim regional court in Germany ruled against an Apple appeal.

The court backed an earlier decision that banned Apple from offering the service for synchronizing emails on Apple’s mobile devices that use iCloud.

The court said Apple must pay damages to Motorola Mobility, but didn’t specify the amount.

The judge adjourned a decision on mobile communication standards, which Motorola Mobility regards as standard-essential. He didn’t say when the court will rule on this patent case.

So much for Instagram defections, displaces its buyer Facebook as No. 1 iOS App

O.K., here is another Instagram story, but now its about the iOS app landing the No. 1 free app spot in the App Store for the first time—despite much media attention on the subject of it selling out to Facebook.

Hipsters everywhere donning their skinny jeans took to Twitter to post one last heavily filtered image, while threatening to delete their Instagram accounts after news broke earlier this week that social network giant Facebook bought the app for a cool $1 billion.

Many tweets and reports even detailed how to keep Instagram photos from Mark Zuckerberg’s acquisitive hands through export services like Instaport.me that essentially leave users free and clear to erase the Instagram app from their smartphones.

The public’s warning now seems empty, of course, as Instagram itself used Twitter this morning to announce its sudden surge in popularity. It looks as though the intense press scrutiny only encouraged the iOS app to soar up the charts. Meanwhile, its new parent company does not even sit in the top 25 free apps in Apple’s App Store.

Do you need to worry about that Facebook iOS security issue?

Probably not.

The “hacks” require the attacker to have physical access to your device (whether it be Android or iOS). That could be a speaker dock, a charging station, or a friend’s computer, but it still requires you to plug the iPhone into something compromised or give up physical access to it.

The issue, as Gareth Wright first discovered, is that Facebook stores saved account information in a plaintext file that can be transferred to another phone and used to log into your Facebook account without signing in. Other services, like Dropbox, were also shown to have the same vulnerability (but that is disputed).

This is why, when you restore a phone from a backup, you already have access to your Facebook app without having to sign-in again. Facebook attempted to dispel the concern by claiming that a phone would need to be compromised for this to work. That is untrue.

However, as we know, once someone with the right software has your iPhone, your information is pretty much his or hers to use.

The bigger issue here is the software that people use to access your data. It is free—and the process is very simple. I expect Facebook and Apple will probably make it more difficult in forthcoming updates.

Biographer disputes Google CEO’s take on Steve Jobs’ anger at Android

Yesterday, as part of a wider interview with Larry Page, Bloomberg quoted Google’s CEO as saying:

I think the Android differences were actually for show. I had a relationship with Steve. I wouldn’t say I spent a lot of time with him over the years, but I saw him periodically. Curiously enough, actually, he requested that meeting. He sent me an e-mail and said: “Hey, you want to get together and chat?” I said, “Sure, I’ll come over.” And we had a very nice talk. We always did when we had a discussion generally….I think that [Anger at Android] served their interests. For a lot of companies, it’s useful for them to feel like they have an obvious competitor and to rally around that. I personally believe that it’s better to shoot higher. You don’t want to be looking at your competitors. You want to be looking at what’s possible and how to make the world better.

However, Page likely was not present for the behind-the-scenes remarks from the former Apple CEO. Jobs probably put on a more distinguished game face, especially in the last meeting the two had when Jobs was very ill. In addition, Jobs’ anger was more than likely focused on former Apple board member and then previous Google CEO Eric Schmidt.

Biographer Walter Isaacson was present behind-the-scenes with Jobs, and last night he disputed Page’s assertion that Jobs’ anger was “for show”:

Isaacson continued: “It’s almost copied verbatim by Android. And then they licence it around promiscuously. And then Android starts surpassing Apple in market share, and this totally infuriated him. It wasn’t a matter of money. He said: ‘You can’t pay me off, I’m here to destroy you’.”

As for what will happen now that Jobs isn’t around to go ‘thermonuclear’ on Google, Isaacson thinks that Apple CEO Tim Cook will handle things differently. “Tim Cook will settle that lawsuit”, Isaacson added.

Google CEO Larry Page says Steve Jobs’ fury over Android was just to rally troops

In a recent interview with Bloomberg Businessweek, Google’s Chief Executive Officer Larry Page talked at length about his new role as chief and his plans for the future of Android, Motorola, and the rest of the company. Much the interview revolved around Android and Google’s relationship with other companies, and Page was asked about his relationship with Steve Jobs toward the end. He was also asked about the state of Android tablets and his thoughts on Apple’s recently announced dividend.

When the interviewer mentioned Google and Jobs had their “differences” about Android, presumably referring to Jobs’ claims that Android is a “stolen product,” Page claimed Jobs’ anger toward Android/Google was “actually for show”:

High school kids are three times more likely to have iPhones than adults?

Piper Jaffray’s Gene Munster has surveyed kids for a many years on their electronics usage. This spring, he polled 5,600 students, and half the group was male, while the other half was female. A surprising 34 percent of high school respondents said they owned an iPhone and 40 percent said they planned to get one in the next six months:

This is surprising, because comScore released its own Mobile phone breakdown today that claimed only 13.5-percent of ages 13 and up owned Apple phones:

Included in that 13.5-percent are supposedly those 34 percent of high school kids, meaning the adult population would have to be even lower than 13.5-percent, which also means high school kids are three times as likely to own an iPhone as their parents if the numbers are right.

comScore: Android and iOS grab 80 percent US marketshare, Apple passes Motorola

Following Nielsen’s latest survey that showed over 90 percent of United States smartphone buyers are choosing iOS or Android, research firm comScore today released its data of the top smartphone platforms and OEMs in the U.S. The survey included more than 30,000 people over a three-month period ending February 2012. It found Android was up 17 percentage points from a year ago with 50.1-percent of the U.S. smartphone market. In comparison, Apple’s 30.2-percent accounted for an increase of 5 percentage points from the same period a year ago.

According to comScore, Google passed the 50 percent milestone for the first time during February 2012. The numbers represent a 3.2-percentage point increase over previous three-month period for Google, and a 1.5-percentage point increase for Apple.

Analyst: AT&T & Sprint selling more iPhones than all other smartphones combined

While noting its March numbers indicate continued growth for the iPhone’s marketshare, Canaccord Genuity analyst Mike Walkley (via AllThingsD) said the iPhone is currently outselling “all other smartphones” at both AT&T and Sprint together. He also said Verizon is selling roughly as many iPhones as all Android phones combined:

Changewave: New iPad customer satisfaction is off the charts

The first customer satisfaction survey since the release of the new iPad shows that owners are almost completely smitten with their new devices.

Changewave surveyed 200 new iPad owners from March 22 to March 28 and found that those “Very Satisfied” were up 8 percent from the iPad 2 to an impressive 82 percent.

And those heat “issues”?  Not a big problem.

Game Over: Latest Nielsen survey says over 90 percent of US Smartphones purchased in last 3 months are iOS or Android

With iOS gaining roughly 30 percent United States marketshare as of Q4 2011 at the expense of RIM, Nokia and Microsoft, new numbers from Nielsen’s latest study show just how much of a duopoly the U.S. market has become. While noting about 50 percent of mobile subscribers in the U.S. are now smartphone owners, Nielsen gave a breakdown of how the two leading platforms continue to dominate as of February 2012:

Apple generates four times more revenue for Google than Android devices

Google gave a testimony to Congress last year claiming it earned two-thirds of its mobile revenue from iOS devices, but now it seems as though the company’s estimate might have been low.

Google made less than $550 million in revenues for Android between 2008 and 2011, while making four times as much revenue during the same period with Apple products that employ Google services like Search and Maps.

According to The Guardian, the settlement offer provided yesterday by Google to Oracle depicted Android’s revenue streams. Settlement discussions ordered by Judge William Alsup were derailed when Oracle rejected Google’s low offer to pay royalties on Android if alleged patent infringements deem true in court.

Reuters reported yesterday that the settlement stems from a 2010 lawsuit where Oracle claimed its Java-related patents were infringed by Android. Oracle acquired the intellectual property in question when it purchased Sun Microsystems in 2010.

Earlier today, we noted that PC World tested the new iPad against some Android tablets for heating during use and found it to be on the high-end but not always the hottest.

Wired did its own tests and found the new iPad to be middle of the road…

New iPad as 25+ hour LTE hotspot, runs cooler than some Android tablets

There are two interesting pieces of information this morning on the new iPad.

If used solely as an LTE MiFi, AnandTech got a mind-numbing 25.3 hours of Verizon LTE hotspotting out of the new iPad. That is equal to about five to seven MiFis.

Now for the killer. If you have an iPad on Verizon’s LTE network and use it as a personal hotspot (not currently possible on the AT&T version), it will last you roughly 25.3 hours on a single charge. Obviously that’s with the display turned off, but with a 42.5Wh battery driving Qualcomm’s MDM9600 you get tons of life out of the new iPad as a personal hotspot.

By my calculations, that means you could download 182GB of data at 2MB/sec on LTE through a single charge or over 18 times Verizon’s highest data plan in a single day.

In addition, PCWorld tested the heat on the new iPad and compared it to the ASUS Eee Transformer Prime and Samsung Galaxy Tab under the same conditions. Without the charger plugged in, the new iPad was actually cooler than the Samsung Galaxy Tab—even with a bigger battery after playing a game for an hour.

The point is that the new iPad runs only slightly hotter than high-end Android tablets and only when charging. The cool champion is still the iPad 2 when playing graphic intensive games.

Report: Apple to add Baidu to iOS search options next month

Reports are surfacing in China that claim Apple plans to integrate Baidu into iOS next month as the country’s possible default search function.

According to Chinese news website Sina Tech (machine-translation):

Sina Technology News on March 26 morning news, according to informed sources, Apple iOS operating system next month will be formally introduced Baidu search, Baidu and Apple between cooperation component in the China region.

Google’s Susan Creighton revealed last fall that two-thirds of the Mountain View, Calif.-based Company’s mobile search comes from Apple iOS devices.

Meanwhile, recent speculation claims Apple is moving to an in-house Mapping solution that would replace Google Maps. The firm also recently removed its publish to YouTube option in QuickTime for Mountain lion. If these latest rumors deem true, Apple’s move to Baidu would further indicate a significant effort to reduce Google’s presence in iOS.

With that said, the move to Baidu might be more than a snub to Google. As SearchEngineLand noted, Baidu holds 80 percent of the search market in China, and it would make sense for the Chinese to carry the same search on their mobile devices as they have on their desktop.

Apple’s court woes: AppleCare in Italy; Motorola, lawmakers grill iOS devs

As we reported earlier this month, Apple was set to appeal a $1.2 million fine imposed by Italian anti-trust authorities Autorità Garante della Concorrenza e del Mercato. The authorities argued Apple is misleading consumers by selling its one-year AppleCare warranties without informing customers of a two-year warranty mandatory by European Union law. Apple officially lost the appeal in court this week, which forced the company to pay the €900,00 fine and alter its AppleCare policies to properly inform consumers going forward. Apple can still appeal the decision, but consumer groups from 10 other countries are also requesting Apple change its policies—indicating this could soon be EU-wide. (via Repubblica.it)

Following the Path incident, a letter sent from lawmakers to Apple in February requested information on how the company collects personal data. The two congressional representatives behind the letter, Henry A. Waxman and G. K. Butterfield, sent letters to 34 app developers requesting similar information. One of the letters was sent to Tim Cook and Apple about the “Find My Friends” app. The letters are requesting that developers answer questions about their privacy policies and how they handle user data. In response to Path, Apple already confirmed, “Any app wishing to access contact data will require explicit user approval in a future software release.”

Earlier this month, we reported that U.S. Circuit Judge Richard A. Posner ruled in favor of Apple’s request to view documents related to the development of Android and the Google/Motorola acquisition. Apple claimed, “The Android/Motorola acquisition discovery is highly relevant to Apple’s claims and defenses.” According to Bloomberg, Apple told the courts last week that Motorola has yet to fulfill the original request, but Judge Posner denied Apple’s request this week and said, “Motorola’s objections are persuasive.” Two patent infringement-related trials between Apple and Motorola are set for June, and Posner warns Apple will have to “narrow its request to a manageable and particularized set of documents” for any future production of data requests.

Sprint CEO: iPhone users are more loyal, use less data

Reports from the Wall Street Journal last October revealed Sprint’s Chief Executive Officer Dan Hesse convinced the company’s board to take on a staggering commitment of approximately $20 billion to purchase 30.5 million iPhones over four years. At the time, Hesse said Sprint “would likely lose money on the deal until 2014. ″ He also claimed not having the iPhone was “the No. 1 reason customers leave or switch.” In an interview with Mobile World Live (via BGR), Hesse defended the decision and claimed, among other things, that iPhone users are “more profitable than the average smartphone customer.”

 Subsidies are heavy for the iPhone. This is the reason why a high percentage of new customers is important… But iPhone customers have a lower level of churn and they actually use less data on average than a high-end 4G Android device. So from a cost point of view and a customer lifetime value perspective. They’re more profitable than the average smartphone customer.”

Hesse went on to claim that Sprint was “pulling a lot of customers” from AT&T and Verizon during the fourth quarter by noting four out of every 10 iPhones the carrier sold were new customers. According to Hesse, that is around double the rate of the other carriers.

Steve Jobs tried to hire Linux founder a decade ago

This is an interesting little paragraph from Wired’s profile of Linus Torvalds, the founder of Open Source Linux OS:

Torvalds has never met Bill Gates, but around 2000, when he was still working at Transmeta, he met Steve Jobs. Jobs invited him to Apple’s Cupertino campus and tried to hire him. “Unix for the biggest user base: that was the pitch,” says Torvalds. The condition: He’d have to drop Linux development. “He wanted me to work at Apple doing non-Linux things,” he said. That was a non-starter for Torvalds. Besides, he hated Mac OS’s Mach kernel.

Linux is now the core of many operating systems, such as Android, Chrome WebOS, and a few others. If Apple hired Torvalds in 2000, Linux might not have made it to 2012.

The No. 1 app on iOS and Android is OMGPOP’s ‘Draw Something’

Pictionary-like drawing game “Draw Something,” developed by OMGPOP, has quickly become one of the hottest mobile apps for both of the industry’s leading platforms. A few days ago, the developer told TechCrunch it reached 25 million registered users, 10 million active daily users, and close to 1 billion paid ad impressions every day. That is just over 5 weeks after launching. With even more press following reports that Zynga is in talks to acquire developer OMGPOP, the app is continuing to climb app charts in both the App Store and on Google Play.

Currently the app sits at No. 1 in both stores as the No. 1 Top Paid and Top Free iPhone app in the App Store, and the No. 1 Top Free app on Google Play. The app is also currently the No. 1 Top Free iPad app in the game category and in the Top 5 of many other charts in over 80 countries. It looks like the company might get picked up by Zynga, which is not surprising, because a gain of 3.5 million daily users over the last week saw Draw Something take over Zynga’s “Words With Friends” as the most popular Facebook Connect game, according to AppData.

Study: Smartphone owners demand bigger screens, prefer 4+ inches

An interesting study out of Strategy Analytics today says that United States and United Kingdom smartphone owners “prefer device screens in the 4.0-inch to 4.5-inch range, as long as the device is also thin.”

“Almost 90 percent of existing smartphone owners surveyed chose a prototype smartphone with a display larger than their current device,” commented Paul Brown, a Director in the Strategy Analytics User Experience Practice. “This trend is driven by increased mobile web browsing ability, as well as engaging video and gaming experiences.”

Not surprisingly, women overall chose smaller phones than men, and existing Android users chose bigger screens than iPhone users. Still, it seems Apple’s customers would prefer a bigger screen.

Kevin Nolan, Vice-President for the User Experience Practice at Strategy Analytics, added, “In order for smartphone owners to adopt larger devices, it is important for handset manufacturers to ensure that mobile devices are not too heavy and that the devices remain thin enough for purses and pockets.”

The data seems to line up with our January poll of 9to5Mac readers in which the majority prefers the next iPhone to be 4-inches or more:

Cheap Kindle Fire absorbed some tablet marketshare ahead of new iPad launch

IDC just released its Q4 2011 report on tablet shipments and Apple continues to lead the market with 54.7-percent of global market share despite being down from 61.5-percent in the quarter before. Apple did increase shipments to 15.4 million units in Q4 (up from 11.1 million in Q3), but experienced an overall decrease in market share thanks to strong gains from Amazon’s Kindle Fire and other Android devices from competitors such as Samsung.

Kindle Fire is now the iPad’s biggest competitor with 16.8-percent of the tablet market due to 4.7 million units shipped during Q4, which is followed by Samsung with 5.8-percent of the market (up from 5.5-percent in Q3). IDC noted Apple’s results for the quarter represent “an increase of 110.5-percent from 4Q10.” The Nook Tablet from Barnes & Noble came in fourth, but it fell slightly to 3.5-percent of the market (from 4.5-percent the quarter before). Pandigital took the No. 5 spot, but it is down from 2.9-percent to 2.5-percent market share.

As for iOS vs. Android, IDC is expecting Android to overtake iOS for global market share by 2015 and noted that Android now has 44.6-percent of the market as of Q4 2011. That resulted in a decrease for iOS, which fell from 61.6-percent to 54.7-during the quarter. As we noted before, IDC’s report accounts for tablet shipments and not actual sales. We know Apple typically sells as many new devices as it can make, and the same cannot be said for devices shipped by all Android vendors. It’s obvious now? The next iPhone is called…“the new iPhone”

So about two weeks ago we got a tip from a reliable source that Apple was going to call the iPhone 5 (or whatever)- the new “iPhone”.

That seemed a little nuts at the time but what a difference a Keynote makes. As Christian explained, Apple chopped the suffix off if the iPad as part of a branding makeover that will likely expand.  Just like iMac is not called iMac 1,2,3 it looks like Apple won’t be doing the numbering on iOS devices (though it never did with the iPod touch).

So that tip –That the next iPhone is simply the new “iPhone” – seems a lot more plausible now.

Apple seeking to settle for up to $15 per Android device in patent disputes

Following a report from Bloomberg in December featuring advice from analysts, we asked you if Apple should settle for up to a $10 royalty per Android device and not keep paying its lawyers to fight patent disputes. Today, Dow Jones Newswiresreports that Apple is interested in seeking settlements. According to the report, Apple “indicated a willingness to cut deals with competitors,” including Motorola and Samsung:
