Apple asks judge to throw out app monopoly lawsuit, says there’s ‘nothing illegal’ about a closed system

Apple asked a federal judge today to throw out a lawsuit originally filed in 2011 that claimed the company has a monopoly over iOS apps by not allowing iPhone users access to an “aftermarket” of applications. Bloomberg reported that U.S. District Judge Yvonne Gonzalez Rogers did not resolve the matter today, but Apple’s lawyer Dan Wall argued Apple’s “closed” system doesn’t violate antitrust laws:

Apple doesn’t set the price for paid applications, and charging a price for distribution of a product on a new and unique platform doesn’t violate any antitrust laws, said Dan Wall, Apple’s attorney, at yesterday’s court hearing in Oakland, California.

“There’s nothing illegal about creating a system that is closed in a sense,” Wall told U.S. District Judge Yvonne Gonzalez Rogers.

“Can a consumer go somewhere else to buy Angry Birds for the iPhone?” asked Alexander Schmidt, an attorney representing seven consumers who sued. “If the answer is no, then Apple is a monopolist.”

Google Maps version 1.1: Google Maps for iOS gets the ability to search Google Contacts, quickly access search for local places, and select between Kilometers or Miles. Google announced the new features in a blog post and also noted that it is rolling out the English version of the app to seven new countries including: Bahrain, Egypt, Lebanon, Oman, Qatar, Saudi Arabia, and UAE.

Your Google Contacts are now integrated into Google Maps for iPhone – meaning that when you’re signed-in and search for a friend’s name, their address will appear as a suggestion (if you have their address saved). Simply tap their name to see the address, which will visible only to you, on the map. To learn an easy way to keep your Google Contacts synced with your iPhone, click here.

Apple releases iBooks 3.1 with support for iBookstore in Japan, local content & improvements for reading Asian language books

Apple released version 3.1 of iBooks today on the App Store and with it comes hundreds of thousands of Japanese books to the iBookstore in Japan. Among the local content on the iBookstore in Japan is light novels and manga, while Apple also noted that it has made “a number of improvements for reading Asian language books.”

AllThingsD reported in January that Apple was in talks with Japanese publishers to work out deals for the iBookstore, which had lacked local Japanese content since it first launched in 2010. Up until now, the store in Japan has consisted of mostly public domain content, but it appears Apple has finally come to an agreement with a many of the large publishers in the country.

What’s New in Version 3.1

The iBookstore in Japan now has hundreds of thousands of books available for purchase, including fiction,
manga, light novels and more. This version of iBooks also includes a number of improvements for reading
Asian language books.

Twitter puts TweetDeck’s mobile apps out to pasture

Twitter updated TweetDeck for Mac just last month with over 90 new fixes and features.

However, for those of you who use TweetDeck on iPhone, there is some bad news afoot:

To continue to offer a great product that addresses your unique needs, we’re going to focus our development efforts on our modern, web-based versions of TweetDeck. To that end, we are discontinuing support for our older apps: TweetDeck AIR, TweetDeck for Android and TweetDeck for iPhone. They will be removed from their respective app stores in early May and will stop functioning shortly thereafter. We’ll also discontinue support for our Facebook integration.

The Week in Tweaks: OS X dock features, iMessage typing indicators, and more for your jailbroken iOS device

Here’s a look at some of the most fun or useful jailbreak tweaks that came out this week. If you like these tweaks, but don’t have a jailbroken iOS device, you can check out jailbrea.kr to learn more about how to jailbreak your iPhone, iPod touch, or iPad.

ActiveDock – $1.99
ActiveDock (screenshot above) brings most of the features of the OS X dock to iOS: the Mountain Lion design, the “running” indicators on apps currently open in the background, and even bouncing animations for alerts and while apps are opening. The tweak allows you to customize the frequency of the notification alert bounces, so instead of the icon constantly bouncing, you can set it to only jump up and down every few seconds. Each feature of the tweak has its own toggle so you can choose which parts you do and don’t want to keep enabled all the time. The effects only apply to the dock, so you won’t have apps jumping up and down all over your homescreens. You can find ActiveDock on the BigBoss repo.

Evernote reports security breach and resets passwords, releases Mac app update with ‘QuickNote’ feature

Earlier today, Evernote, a popular note taking application that works across multiple devices, reported that customer data such as usernames, passwords, and email addresses had been breached and accessed by a third party. However, user content stored within Evernote was reportedly not accessed. Evernote also notes that all user passwords are encrypted (hashed and salted), but, in an “abundance of caution,” all Evernote user passwords have been reset.

While our password encryption measures are robust, we are taking additional steps to ensure that your personal data remains secure. This means that, in an abundance of caution, we are requiring all users to reset their Evernote account passwords. Please create a new password by signing into your account on evernote.com. After signing in, you will be prompted to enter your new password. Once you have reset your password on evernote.com, you will need to enter this new password in other Evernote apps that you use. We are also releasing updates to several of our apps to make the password change process easier, so please check for updates over the next several hours.

In addition to announcing the breach, the company says that it will release updates to its software to make the password change process simpler.

The Mac app update has already been released (not on the Mac App Store), as noted by MacStories. In addition to the password enhancement, the new Mac app update adds a new “QuickNote” popover (pictured below) for quick inputting of notes into Evernote:

League of Legends lands in open beta on Mac, download now

Developer Riot Games announced today that its very popular, previously PC-only title League of Legends is now available in open beta for Mac users. That means anyone can now download the Mac client from the League of Legends website.

Riot Games promised the Mac client will do “everything that the PC client does.”

The Mac client does everything that the PC client does, meaning you’ll get all future features, bug fixes and new content on the same schedule as PC players, but on your native OS. The Cross-Platform team will also continue working diligently to smash any Mac bugs that surface during the open beta.

Stream David Bowie’s new album free on iTunes until its March 12 release

It’s been a long time since the release of David Bowie’s last album in 2003 but today, to mark his return, his upcoming release is available to stream in its entirety for free on iTunes. The new album, The Next Day, will release March 12 with 14 tracks and 3 bonus songs. A single titled ‘Where Are We Now?’ is available to purchase on iTunes now.

Real Racing 3: The highly anticipated third installment in EA’s Real Racing iOS series has officially arrived in the US App Store today (via 9to5Toys). Available now for free, the game’s new in-app purchase model is getting a little bit of negative attention, but otherwise reviews of the game have been quite positive.

Trailblazing new features include officially licensed tracks, an expanded 22-car grid, and over 45 meticulously detailed cars from makers like Porsche, Lamborghini, Dodge, Bugatti, and Audi. Plus, racing with friends gets kicked into another dimension with the reality-bending Time Shifted Multiplayer™ (TSM) technology.

AVP: Evolution: Fox has released another app in the Alien vs Predators series with the release of AVP: Evolution. The game was developed by Angry Mob Games, makers of PREDATORS and Guerrilla Bob iOS titles, and takes cues from multiplayer modes in recent AVP console releases.

Socialcam version 5.0: Autodesk is making some major improvements to its popular Socialcam app, which has now reached 20 million downloads, with the release of version 5 on the App Store today. The update should be hitting the App Store shortly and with it will come “a complete redesign of visual effects, 720p HD video, video High Dynamic Range (HDR), and a new icon for Socialcam.”

Day One version 1.10: The well reviewed journal/diary app known as Day One gets new features today including new options for PDF Export and Printing, historical weather reports for 30 days, a new reminder sound, Sanchez font option, and improvements to HTML styling. There are also a number of performance enhancements include for startup time, Dropbox syncing, and more. An update for the Mac app is coming soon.

Cycloramic version 2.1: The app that received much attention for its unique use of the iPhone’s vibrating motor to snap hands-free 360 degree video gets new features today. Among them is the ability to “convert panoramic photos to 24 second panoramic HD movies.”

YouTube 1.2.1: Google updated its YouTube app for iOS bringing the Send to TV feature that it originally introduced on Android devices back in November. The app will allow users to send YouTube videos from their iOS devices to a Google TV, PS3, or Xbox and Google confirmed back in January that the feature would be coming to even more smart TVs this year.

Review: Files is the ‘Finder for iOS’ you’ve been waiting for

For years, iOS users have wanted a proper way to save, open, and store files on their devices. While Apple has given us a partial solution with “Open In…” sheets, the folks at SonicoMobile have taken it upon themselves to go a step further. Today, they have launched a new app called Files that aims to be the missing “Finder for iOS.”

Spotify, Tweetbot, PanoPerfect for iPad, Waze, Bad Piggies, AppHero 2.0, more

In addition to a new Cloud Player app for iPad from Amazon and the roll out of iTunes in the Cloud features to new countries, below we have put together our usual list of notable apps and updates hitting the store today:

Spotify version 0.6.0: Perhaps the biggest update today goes to the Spotify iOS app which, on top of receiving a “shiny new interface” equipped with a sidebar, includes a “Now Playing” bar, a new Track menu, and a number of other new features and fixes:

• New: Shiny new interface. You can navigate around the app with a new sidebar. Check it out by swiping left-to-right, or by pressing the ≣ button in the top left of the app.
• New: Now Playing bar. You’ll always see what you’re listening to along the bottom of Spotify. To switch tracks, just swipe along it. Tap or drag to see more information about the current track. Tap the cover art in the extended view to use AirPlay, and disable/enable shuffle and repeat.
• New: Track menu. Tap the … button on any track to see a redesigned context menu.
• Fixed: “Track only available online” issues. This would sometimes appear after start-up, or when you’d been offline for a little while. Not any more.
• Fixed: Lock screen will now always display the correct track.
• Fixed: Shuffle now switches off after you’ve used “Shuffle Play” on an album or playlist.

Waze version 3.6: Waze, one of Apple’s Maps partners and an app CEO Tim Cook recommended as an alternative during the iOS 6 Maps controversy, gets some nice new features today. Among the new features is real-time road closure reporting and routing, a refined map with only relevant road names, and much more:

✓ Report pins tilted on map to better indicate direction of event
✓ Reduced map clutter by showing only relevant road names
✓ New moods!
✓ New inbox with multiple message selection
✓ Update gas prices popup: When in gas station users prompted to update price (Europe only)
✓ Optimized performance and multiple bug fixes

PanoPerfect for iPad: We’ve told you about the PanoPerfect app before– an Instagram type experience designed specifically for sharing panorama shots. Today the developers have released its first iPad version of the app and also revamped the iPhone app.

PanoPerfect is a free, fun, and simple way to share beautiful panoramic photos on your iPhone. Find, follow, and share gorgeous panoramic photos with friends. Panorama’s go into a stream where you can comment and like your favorite ones.

Bad Piggies version 1.2.0: Rovio’s popular Bad Piggies franchise gets updated today with 30 new “Flight in the Night levels,” 6 Road Hogs levels, new achievements and much more. The free apps and HD iPad versions receive the same update today.

Tweetbot version 2.7.3: The iOS versions of the Tweetbot apps get a few tweaks. The iPad version gets the same update:

Apple rolls out iTunes in the Cloud movies and TV shows in France, Denmark, Greece, Norway, Sweden & Holland? (Update: Apple confirms)

Update: TNW confirmed with Apple that a total of 12 countries have received access to movies in the Cloud, while France is the only to get TV shows today:

Belgium, Cyprus, Denmark, Finland, France, Greece, Luxembourg, Malta, Netherlands, Norway and Sweden have all received the service, which allows access to previously downloaded movies. Apple confirmed with us by email that France was the only country in this batch to receive iTunes in the Cloud for TV shows.

As first reported by French website iGen.fr, Apple appears to be rolling out iCloud access to TV shows and movies in France. The feature allows users to download content purchased through iTunes to various Apple devices, and it has been available in the United States and elsewhere since 2011. The site first noticed access to the movies and TV show sections in the iTunes desktop app but confirmed the content is also accessible from Apple TV in the country.

As noted by TNW, a small number of users on Twitter are also reporting that access to TV shows and movies in the cloud is also now available in Holland and Sweden.

Other readers have said the feature is also available in Denmark, Greece, and Norway:

It’s not clear if Apple has officially launched the feature or access has mistakenly been opened up temporarily. Apple has yet to update its iTunes in the Cloud availability page to reflect the rollouts.

MLB increasing Passbook support from 4 to almost half of all Major League stadiums in 2013

On top of just recently updating its At Bat 13 iOS app for Spring Training with a ton of new features, MLB announced at an event last night in New York that it will increase the number of stadiums accepting Passbook this season. According to a report from GigaOm, the number of stadiums accepting tickets through Apple’s wallet app will increase from just four to 13:

The teams that will start accepting Passbook tickets for the first time are the Minnesota Twins, Baltimore Orioles, Milwaukee Brewers, Oakland A’s, Pittsburgh Pirates, Detroit Tigers and Chicago Cubs. The New York Mets, San Francisco Giants and Kansas City Royals, which began accepting Passbook last September, will again offer the service this season. MLB says there are three more teams that will enable iOS tickets this season, but that are not yet ready to make an official announcement.

CEO of MLB’s Advanced Media Office Bob Bowman told GigaOm that iOS users currently make up approximately 70 percent of all At Bat users and around 85 percent of paid subscribers. The updated iOS At Bat app includes a classic games video library archive, re-architected app navigation, and searchable video highlight library expansion to include access to complete video archives.

Apple settles in-app purchasing class action, agrees to pay $5 iTunes credit or cash refund

Last time we checked in on the in-app purchase class-action lawsuit against Apple, courts refused Apple’s request to throw out the case brought on by parents arguing the iOS freemium model, i.e. in-app purchases, allowed children to easily rack up hundreds or thousands of dollars. Today, Law360 (via GigaOM) reported Apple has agreed to pay a settlement and will be contacting 23 million iTunes users that “made a Game Currency purchase in one or more Qualified Apps.”

According to the report, Apple will pay $5 in iTunes credit to those who claim in-app content was purchased by a minor without their permission. For purchases above $30, users will be able to request a full refund. However, credits will likely not get to users until early 2014 when the settlement meets regulatory approval:

Facebook releases SDK 3.2 for iOS with better analytics, API improvements and more

Facebook announced on its Developers blog today that it is releasing version 3.2 of its SDK for iOS. The updated SDK makes it even easier for iOS app developers implementing Facebook features, with improvements to APIs and better tools for tracking usage and optimizing ads. Version 3.2 includes improved analytics and new metrics such as the ability to track “iOS 6 native share sheet and built-in native UI controls usage.” Facebook also noted that it is including a beta for select partners showing off upcoming support for “logging in-app purchase events.”

Better mobile analytics – We’ve added support for measuring additional usage metrics and optimizing ads to help improve an app’s quality and monetization potential
Enhanced error handling – SDK support and documentation now enabled for all classes of error responses
API improvements – A new FBAccessTokenData type makes it easier to open a session from token data explicitly, and to better handle app and deep linking

Facebook also said the updated SDK included enhanced error handling, improved web dialog support, and a several API improvements and bug fixes. Improvements to Facebook’s SDK are important, as the company’s noted over 45 percent of the top 400 grossing iOS apps are now integrated with the social network.

iOS developer cleverly adds Street View app as a routing source for iOS 6 Maps

Recently launched on the App Store, a 99-cent app from developers FutureTap called simply “Street View” will allow users to quickly access Google Street View from seemingly within the stock iOS 6 Maps app.

When Apple first launched its new Maps app with iOS 6, one of the features many users missed was Street View’s 360-degree panoramas made popular by Google Maps. Things got a little better with the introduction of the Google Maps iOS app months later, but there are still a few reasons why many have not completely migrated away from Apple’s stock Maps app.

The biggest (at least for non-jailbroken users) is the inability to use third-party apps as the default mapping application. That means when tapping links for addresses or using Siri, for example, Apple will still default to its stock iOS 6 Maps app. Thankfully, with the 99-cent Street View app, you can continue using Maps and still be able to quickly pull up Street View without ever feeling like you’ve left the app.

Finish app developers discuss their success (Video)

Sixteen-year-old app developers Michael Hansen and Ryan Orbuch, creators of the increasingly-popular to-do app Finish, were interviewed on Fox News’ morning show Fox and Friends today.

During the interview, the Colorado-based duo described the process that went into creating their hit app, what it was like to be featured by Apple, and more.

After the interview was over, Orbuch, the team’s designer, noted on Twitter that their app has risen to the 35th spot on the overall App Store charts and seems to show no signs of slowing. Be sure to check out our review of Finish for more about the app.

Facebook for iOS updated with easier sharing and commenting, free calling within app

Facebook has updated its official iPhone, iPad, and iPod touch application with a number of enhancements. Notably, version 5.5 of the app includes a new button design that makes Liking, commenting, and sharing stories easier. Additionally, Facebook has brought the free calling to friends feature from the Messenger app (as seen in the above screenshot) right into the standard Facebook app.

MLB updates At Bat 13 app for Spring Training

MLB’s At Bat 13 app will get a Spring Training update today for iPhone, iPad, Android, and Kindle Fire devices.

The update is not yet live but will include multi-platform live audio access for At Bat 13 subscribers with account portability for listening to live games on Macs and PCs. It also offers universal iOS and Android support for At Bat 13 subscribers with full feature accessibility across all supported smartphones and tablets.

The app’s new key features will range per device: sortable batting, pitching, and fielding statistics and favorite team enhancements is for iPad and Android tablets, for instance, while re-designed individual team pages, an updated news section interface, and expanded video highlight integration is for iPhone and Android phones.

New features for all devices include a classic games video library archive, re-architected app navigation, and searchable video highlight library expansion to include access to complete video archives. The iPhone version will specifically get additional push notification options.

“MLB.TV Premium subscribers again may upgrade to At Bat 13 for free, unlocking all premium features,” explained MLB’s press release. “Fans also may subscribe to MLB.com At Bat 13 for the one-time annual fee of $19.99, covering the entire season through the World Series. iOS users may pay $2.99/month with the recurring billing offering.”

MLB also said the Opening Day update will come soon and At Bat will debut on the new BlackBerry 10 by Opening Day. The press release and screenshots are available below for more information.

Netflix version 3.0: Netflix received an update today to version 3.0 and with it came an enhanced playback experience including the ability to view the title from the iPad player UI, the return of the zoom icon for fullscreen playback, and “better placement of play/pause and Back-10 buttons so you can easily control your experience.”

Twitterrific 5.1 brings new features and fixes, teases push notifications en route

Twitterrific 5, the popular new version of The Iconfactory’s Twitter client, has updated to version 5.1. The update introduces several new features and fixes. One of the new features, which you see in the video above, is the ability to mute, or “muffle,” hashtags, users, and even URL domain names. The full change log is lengthy and hints at push notifications coming in the next update:
