‘Steve Jobs’ iPhone patent used against Samsung/Motorola invalidated by US patent office, could affect lawsuits

In October, as pointed out in Samsung filings with U.S. District Lucy Koh, we told you that the U.S. Patent and Trademark Office issued a non-final decision that declared 20 claims related to Apple’s rubber-banding patent invalid. While Samsung and Apple were back in court yesterday regarding post-trial motions, today FossPatents reported (via MacRumors) the USPTO has issued another non-final ruling declaring yet another Apple multitouch patent invalid.

This time it’s a touchscreen patent, commonly called “the Steve Jobs patent,” that courts previously deemed valid in cases against Samsung and Motorola in the past:

This week, the USPTO issued a first Office action rejecting all 20 claims of U.S. Patent No. 7,479,949 on a “touch screen device, method, and graphical user interface for determining commands by applying heuristics”, which has been referred to by many people, including Apple’s own lawyers, as “the Steve Jobs patent”.

The touchscreen heuristics ‘949 patent has also been asserted against Motorola. Judge Posner declared large parts of the patent invalid and identified only some minor potential infringement on Motorola’s part that he decided would not warrant injunctive relief even if Apple prevailed on whatever little was left of its related claims.

Apple says new 27-inch iMac orders will ship in January

Earlier this month, Apple started pushing back the estimated shipping times for its new line of 21.5-inch and 27-inch iMacs. Apple CEO Tim Cook previously warned prior to the launch of the new lineup that the company expected significant delays leading into the holidays. While the 21.5-inch iMacs are still listed at “7-10 days” on at least Apple’s United States and Canada online stores, the 27-inch model is now listed as shipping in “January”. Apple previously displayed “3-4 weeks”.  While we are obviously now only three weeks out until January, the change could mean further delays for the new iMacs and possibly shipments late into January as opposed to at the start of the month.

Ahead of tonight’s airing of the Tim Cook NBC interview at 10 p.m. EST, Bloomberg Businessweek this morning published what it called his “most wide-ranging interview as CEO.” We learned a bit of what to expect from Cook’s NBC interview earlier: Mac production coming stateside in 2013, and an intense focus on Apple TV. However, the Bloomberg piece also offered some interesting tidbits about Cook on a personal level, the recent executive changes, Maps, Jobs, Samsung, and more:

On the departure of Scott Forstall and John Browett:

The key in the change that you’re referencing is my deep belief that collaboration is essential for innovation—and I didn’t just start believing that. I’ve always believed that. It’s always been a core belief at Apple. Steve very deeply believed this…. So the changes—it’s not a matter of going from no collaboration to collaboration. We have an enormous level of collaboration in Apple, but it’s a matter of taking it to another level…. So how do we keep doing that and keep taking it to an even higher level? You have to be an A-plus at collaboration. And so the changes that we made get us to a whole new level of collaboration. We’ve got services all in one place, and the guy that’s running that has incredible skills in services, has an incredible track record, and I’m confident will do fantastic things.

On Jony Ive and his new role at the company:

Jony [Ive, senior vice president of industrial design], who I think has the best taste of anyone in the world and the best design skills, now has responsibility for the human interface. I mean, look at our products. (Cook reaches for his iPhone.) The face of this is the software, right? And the face of this iPad is the software. So it’s saying, Jony has done a remarkable job leading our hardware design, so let’s also have Jony responsible for the software and the look and feel of the software, not the underlying architecture and so forth, but the look and feel…. I don’t think there’s anybody in the world that has a better taste than he does. So I think he’s very special. He’s an original… I love Jony. He’s an incredible guy, and I have a massive amount of respect for him.

Apple’s Tim Cook takes TV project from hobby to ‘intense area of interest,’ says the industry is 20- to 30 years behind

Tim Cook NBC interviewApple CEO Tim Cook’s much hyped NBC interview is set to air tonight at 10 p.m. EST, but we are already learning much of what will be discussed during the conversation that took place in, among other places, Apple’s Grand Central retail store location in New York. Earlier today, a profile from Bloomberg revealed Cook’s plans to bring at least some production of the Mac back to the United States in 2013, but he also hinted that the company has big plans for a next-generation Apple TV product. According to a preview of the interview on NBC’s website, Cook referred to the project as an “intense area of interest”—opposed to the “hobby” that the company has considered the product since its inception:

“When I go into my living room and turn on the TV, I feel like I have gone backwards in time by 20 to 30 years,” Cook told Williams. “It’s an area of intense interest. I can’t say more than that.”

Grand Theft Auto: Vice City for iOS now available on the App Store

Rockstar has been teasing the iOS edition of Grand Theft Auto: Vice City to celebrate the 10th anniversary of the game for a few weeks now. The game officially makes its way to the App Store today, starting with the New Zealand and Russian stores, and it should make its way to the United States and elsewhere shortly. The app is selling in New Zealand for around $5 USD.

Former Apple execs Pascal Cagni, Tony Fadell, and others talk Apple at LeWeb (Video)

The LeWeb conference is running Dec. 4 through Dec. 6 in Paris, and father of the iPod and Nest creator Tony Fadell sat down yesterday to talk about Nest, product design, and the company’s future plans to bring Nest to 500 retail shops starting with Canada. Of course, as usual, Fadell’s former employer Apple was a topic of conversation. Fadell talked a little bit about what he learned from Steve Jobs in terms of product design, and he talked about his time at Philips compared to Apple and Nest.

Another interesting guest that made an appearance is Apple’s former Vice President and General Manager for Europe, Middle East, and Africa Pascal Cagni. He resigned in May. Pascal talked about his time at Apple and his former role at the company. He also talked about his working relationship with Jobs, his continued admiration for the company, and secrecy at Apple. Gmail iOS 2.0

Gmail version 2.0: Google has just released a major update to its Gmail iOS app, introducing multiple account support, a new look that appears to be partly inspired by its Sparrow acquisition, search predictions and much more. The update also brings interactive Google+ posts support, an infinite scroll inbox, new welcome screen, and  the ability to respond to Google Calendar invites. Google walked through some of the new features of the overhauled Gmail app in a blog post noting the app was six months in the works:

Six months ago, our team set out to completely rebuild the Gmail app for iPhone and iPad to give you you a faster, sleeker, and easier experience on iOS. The result? Version 2.0. With version 2.0 of the app, you’ll get a totally new look and feel, plus a bunch of improvements like profile pictures in messages, numerous new animations from swivels to transitions and infinite scrolling in the message lists.

Kindle version 3.5: Amazon previously rolled out its X-Ray feature, which used to be exclusive to Kindle devices, to iOS devices back in October. At the time, it was only making the feature available for textbooks on iOS. Today, Amazon has updated the Kindle iOS app to extend the X-Ray to all books. The update also includes “Manga Image Rendering Improvements”:

• X-Ray for Books – see the “bones of the book”. X-ray helps you learn more about notable characters, places, and phrases with descriptions from Shelfari.com and Wikipedia.

RE/MAX rolling out Passbook business cards for 4,500 real estate agents in the US

iTunes Music going live in Turkey, Lebanon, Saudi Arabia, Israel, Russia & more ahead of tomorrow’s rumored Russia-based iTunes event (Update: 56 countries)

Update, Dec. 04: Apple issued a press release today confirming iTunes music will be rolling out to a total of 56 countries including India and South Africa. It also confirmed “movies are available today in Russia, Turkey, India and Indonesia.”

Earlier today, we reported that Apple was set to hold an iTunes launch event in Russia tomorrow as the company confirmed availability of the iPhone 5 in the country and many others for Dec. 14. Now, according to several tips from readers and the tweets below, iTunes music is starting to appear for iOS users in Turkey. Over the last couple of weeks, Russian users have noticed iTunes music on the App Store, and appledigger.ru reported today that the music is continuing to go live ahead of tomorrow’s launch event.

Like the cheaper 35-cent to 65-cent USD songs appearing for Russian users, songs listed for Turkish users are listed at 0,89 TL (roughly 50 cents USD). We also received tips that iTunes Match is appearing in both countries for around 799 RUB a year ($25 USD). Another Russian user also noticed an option to rent movies is now available from Apple TV devices in the country.

Apple confirmed earlier today that the iPhone 5 would go on sale in Turkey on Dec. 14—the same day as the Russian launch. So, it would make sense for iTunes music to roll out in the country simultaneously. It’s a possibility Apple will use this launch event to announce iTunes music for other countries, as well. WordPress version 3.3: The WordPress iOS app gets an update today that brings audio feedback with new sound effect options for “refreshing, swiping, and more” accessible from Settings. The app has also been updated with optimizations for iPad mini, support for self-signed certificates, and fixes for over 20 bugs:

Angry Birds Seasons version 3.1.0: Over the weekend Rovio updated its Angry Birds Seasons apps with new content for Winter. Included is 25 winter levels (one each day) and “three secret levels for some special wintry treats.” HD iPad version available here.

It’s a snowy winter night, the northern lights are ablaze, and it seems like peace on earth… until the bad piggies show up! The Angry Birds didn’t realize that they’re walking in a winter wonderham!

Tumblr version 3.2.2: The Tumblr iPhone app gets a few features today include a new blog lookup feature to find blogs by username, and a panorama view when tapping photos:

Apple announces iPhone 5 coming to South Korea & 50 more countries in December

Apple just issued a press release to confirm the iPhone 5 would land in South Korea and 50 additional countries in December. Apple noted that it has currently launched the iPhone 5 in 47 countries. Moreover, with the December launches announced today, it is on track to meet its goal of 100 countries by the end of the year.

South Korea will officially get the device Dec. 7, while other countries will get access Dec. 14, followed by another launch Dec. 21. Here’s the full list:

iPhone 5 will be available in South Korea on Friday, December 7 and on Friday, December 14 in Albania, Antigua and Barbuda, Armenia, Bahamas, Bahrain, Bolivia, Brazil, Chile, China, Costa Rica, Cyprus, Ecuador, Grenada, Indonesia, Israel, Jamaica, Jordan, Kuwait, Macedonia, Malaysia, Moldova, Montenegro, Panama, Paraguay, Philippines, Qatar, Russia, Saudi Arabia, South Africa, Taiwan, Turkey, United Arab Emirates and Venezuela. iPhone 5 will also be available on Friday, December 21 in Barbados, Botswana, Cameroon, Central African Republic, Egypt, Guinea, Ivory Coast, Kenya, Madagascar, Mali, Mauritius, Morocco, Niger, Senegal, St. Kitts, St. Lucia, St.Vincent & the Grenadines, Tunisia, Uganda and Vietnam.

iFixit iMac teardown reveals dual mics, difficult RAM upgrades and glued LCD

While we had some pictures of a brief teardown earlier this week, iFixit has now completed its ritual teardown of the new 21.5-inch iMac that officially went on sale on Friday.

Unfortunately, iFixit described the process as an “exercise in disappointment,” noting the iMac’s new thinner design introduces new hurdles for repairability. Most notably, the device’s glass and LCD are now glued directly to the iMac’s frame, while accessing the RAM, CPU, and hard drive will now mean having to remove the entire logic board:

The late 2012 iMac 21.5″ — code-named EMC 2544 — is an exercise in disappointment for us. We were quite worried when we saw that super-thin bezel during Apple’s keynote, and unfortunately we were correct: the glass and LCD are now glued to the iMac’s frame with incredibly strong adhesive. Gone are the lovely magnets that held the glass in place in iMacs of yesteryear.

A few things noted in iFixit’s highlights: a new rubber housing that “dampens the vibrations from the spinning hard drive,” a new single fan layout, dual microphones, and a 5mm thinner LG made display. Those are some of the highlights of Apple’s new design, but iFixit is scoring the new iMac as a 3 out of 10 (down from 7 last year) due to the many issues with repairability. Here are just a few:

Apple releases update 5.1.1 (10A831) for second and third gen Apple TVs

After releasing update 5.1 for second- and third-gem Apple TVs back in September, Apple rolled out 5.1.1 today to Apple TV owners following the public launch of iTunes 11.The 5.1 update includes Shared Photo Streams, AirPlay, iTunes account switching, and more, so we aren’t expecting to discover much in today’s update.

How the Indianapolis Colts replaced its 800-page playbooks with 120 iPads

In April, when the Denver Broncos swapped out its traditional 500-page playbooks for iPads, we heard rumors that other teams were considering making the switch as well. Other professional sports teams have followed, one of which is the Indianapolis Colts. BizTechMagazine has an interesting piece profiling the team’s purchase of over 120 iPad 3s as playbook replacements for both players and coaches:

“Pagano feels it’s a competitive advantage to give players all the information at their fingertips and for them to learn in a way they have grown accustomed to,” says Ryan Fannin, the Colts’ director of football information systems. “It’s not about pen and paper anymore. We are able to tie a video with a diagram of a play. It helps players learn, and it’s a huge benefit for the team.”

The team also provides game films and video of their practices over streaming video, allowing players to review game and practice footage on their iPad devices. In past seasons, Colts players primarily watched game film using specialized computer equipment at team meeting rooms at the Colts’ practice facility. “It’s much easier,” Fleener says of the iPad ­devices. “You can watch from home.”

When players log in to their devices from the practice facility or from home, they can download the latest playbook from their coaches as well as daily practice schedules, travel itineraries, motivational notes and strategic tips from their position coaches, Fannin says. The digital playbook is more than a PDF. With the app, players can select categories of plays. Coaches can also attach a video to a specific play, so players can see the play in motion.

Analyst: T-Mobile USA might announce arrival of iPhone next week

With T-Mobile Chief Operating Officer Jim Alling hinting that the iPhone was too expensive at a recent conference in Barcelona, it seemed like the carrier planned  to continue with its bring-your-own iPhone strategy for its ever-expanding iPhone-compatible 4G network. However, a note from Merrill Lynch analyst Scott Craig today claimed the carrier could announce a deal to carry the iPhone as early as next week. Fortune has the story:

Now Merrill Lynch’s Scott Craig is out with a note reporting that “speculation is heightening” that Deutsche Telecom (DT) will announce a deal to bring the iPhone to its U.S. subsidiary at next week’s analysts day (12/6-7).

Merrill Lynch’s Craig points out that cutting a deal with the fourth largest U.S. carrier would give Apple access to 98% of the U.S. post-paid market and 75% of the country’s total mobile subscribers.

“While this would be incrementally positive,” he writes, “any financial impact would be limited.” He estimates that a T-Mobile deal would add about 4 million iPhones to his current estimate of 179 million sold in calendar 2013, boosting Apple’s top line (revenue) by 1% and its bottom line (earnings per share) by 2%.
