Obama administration plans to curb patent trolling with 5 step plan

Site default logo image

obama-607

The WSJ reports that after years of worsening patent legislation in the US, the Obama administration has finally decided to try to do something about it.

The president has taken a dim view of certain patent-holding firms. In February, he said some firms “don’t actually produce anything themselves. They’re just trying to essentially leverage and hijack somebody else’s idea to see if they can extort some money out of them.”

Apple, depending on who you ask, is sometimes the agressor in patent cases but is often the victim of  frivolous lawsuits that often earn these patent holding companies millions and millions of dollars. These companies aren’t really companies at all; instead they are just shell companies built around a patent or a portfolio of patents, which are often overly broad or were never intended to be used in a particular way.

These lawsuits often take place in courts in Eastern Texas, where judges are notoriously friendly to trolling interests.

Some examples of companies who’ve questionably sued Apple or its interests: VirnetXPersonal Audio LLC, Lodsys, Motorola? etc.

The administration’s plans in 5 steps:

Plastic iPhone back plate spotted in China or just iPhone 5 in a case?

plastic-iPhone-case-lightning

Numerous global sites are running images this morning with what the posters claim are plastic backings of upcoming ‘value’ iPhones. Because of the lack of any evidence that these are real we’re running these only for discussion. As Mark said last night, these could be anything.

https://twitter.com/markgurman/status/341290891761303554

The above image appears to have a Lightning cable inserted but no markings on the back while the below image seems to show another look at the back.

Nowhereelse.fr applied filters to the top image and from that it appears that the plastic iPhone shell is just a case…

Apple said to be closing music deals in order to launch ‘iRadio’ at upcoming WWDC

Site default logo image

Update: Bloomberg adds more to WSJ’s report from earlier claiming that Apple’s new radio service will be tightly integrated with its iAd business. The report says Eddy Cue is currently making changes to the iAd business to support the new radio service scheduled to launch later this year alongside iOS 7:

Apple, based in Cupertino, California, has been negotiating with advertising companies including Omnicom Group Inc (OMC).’s OMD to secure brands that will run campaigns on the radio service, one person said..The company has taken steps to be more flexible with advertisers to get more business. Apple has required marketers to pay a fee for each 1,000 times an advertisement is placed in an app, plus an additional $2 for every time a customer clicks that ad. In some cases, Apple has eliminated one of those charges, one person familiar with the company said.

Apple also has cut prices so that media agencies can spend $1 million and use the purchased space for different advertising clients. And Apple started taking ad business from companies that sell alcohol, something Jobs resisted after creating iAd, said one person.

We’ve heard no shortage of rumors on the rumored iRadio streaming service from Apple that has taken on some new urgency after Google released a similar service at Google I/O last month (and plans to launch it on iOS soon). The latest comes from the NYTimes, which says Apple is rushing to close deals as days wind down to WWDC’s kickoff on June 10th.

After months of stalled negotiations over its planned Internet radio service, Apple is pushing to complete licensing deals with music companies so it can reveal the service as early as next week, according to people briefed on the talks.

It would appear that Apple wants to announce the service at WWDC, but the company needs to overcome issues with closing some of the deals. CNET reported earlier today that Apple had closed the deal with Warner, one of the bigger labels.

Apple has signed a deal with the Universal Music Group for its recorded music rights, but not for music publishing — the part of the business that deals with songwriting. Over the weekend, Apple also signed a deal with the Warner Music Group for both rights. It is still in talks with Sony Music Entertainment and Sony’s separate publishing arm, Sony/ATV, whose songwriters include Taylor Swift and Lady Gaga.

In a strange irony, the music service Apple offers is, again, said to be free and supported by ads (like Pandora/Spotify/Slacker/etc). This is in contrast to Google’s service, which is sold via a paid subscription.

I would have guessed the opposite, but this may be why Google was able to close the deals with the labels and Apple is still at the table.

WSJ adds that Apple will pay Warner 10% of ad revenue, about twice as much as Pandora, and that the service will be integrated with iAd.

WWDC 2013: Slimmer Retina MacBook Pro w/1080P camera and MacBook Air microphone improvements expected

Site default logo image

specs_camera_2xIn a report this morning, one of the better Apple analysts, Ming-Chi Kuo of KGI securities listed his forecast for MacBook Pro and Air updates expected at WWDC. Apple’s annual developer-centric conference begins on June 10th with a keynote. The biggest change is Apple will move to Intel’s Haswell processors. These chips dramatically reduce power consumption, which in turn could allow Apple to need fewer batteries in the Retina MacBook Pros:

We expect the new MacBook, featuring an upgrade to Intel’s (US) Haswell processor, will be in the spotlight for Apple at the upcoming WWDC from June 10. Along with the new processor, we expect the following modifications to each product line:

Retina MacBook Pro to be slimmer slightly, along with a camera upgrade. We expect the 13” Retina MacBook Pro will have a slightly slimmer form factor for increasing its portability. Also, we think the camera spec will be upgraded from HD to full HD. This will improve Facetime and video conference quality in the high resolution Retina display.

The 1080P camera would match the capabilities of the rear-cameras in recent iOS hardware, but this would represent the first time in which Apple shipped a 1080p-capable front-facing sensor.

Screen Shot 2013-06-02 at 8.53.09 AM

If Apple does choose to keep the same batteries and size of the Retina MacBook Pro, the new Haswell chips could push battery life up over 10 hours – an outcome I’d personally prefer. Additionally, how can you make the 13″ Retina MacBook Pro any thinner?

https://twitter.com/markgurman/status/341193848866873344

It is so thin that the ports+ fan outlets barely fit now. It would also be an uncharacteristically short sub-1-year duration for the current design.

As for the MacBook Air, at least one improvement is expected by Kuo:

Apple attempts to temper expectations of iPad or iPhone launch at WWDC

We’ve been patiently waiting for Apple hardware upgrades since October and heard tale of an iPad 5 launch as early as April but obviously that didn’t happen. So, last night, Tim Cook might have left some hope for iOS hardware at WWDC alongside iOS 7 in less than 2 weeks when he told Walt and Kara:

Kara: Are you thinking about having a more dramatic redesign of what you’re doing, to liven it up. Because it still looks the same… a lot of people are starting to complain…

Walt: when is the next big change… are you going to change the game

Kara: i don’t love it as much… and if i don’t love it as much

Tim: Do I worry about the demographics. No…. we try to appeal to everyone. What’s new. what’s coming. what’s next. when is it coming. as you know I’m not going to answer those. What I can say is that we have our developer conference in less than two weeks. We’re going to be rolling out the future of iOS and OS X and we’re all super excited to to that.

There is some room for interpretation in there that there could be an iOS device launched at WWDC. (We’re still tracking a few Macs for announcement at the event).

But a rare, pre-emptive “Nope” was issued today by Jim Darlymple:

So, don’t expect an iPhone or iPad at WWDC

You really don’t even need an Apple confirmation on things such as this. How would Apple launch a new product with an untested beta iOS 7 at the same time? So we can now put that to bed, instead focusing on the new flat iOS 7 interface spearheaded by Apple’s design guru in residence Jony Ive.

Quick Review: Lightning/30-pin/Micro-USB 4-in-1 Charging cable does the job it’s paid to do

Site default logo image

IMG_6422

Charging/Synching iPhone 4, iPhone 5 and Nexus 4 simultaneously from one USB port

Update: now available at Amazon

We see a lot of cool stuff on 9to5Toys every day but one particular item seemed worth sharing today. I bought the Lightning/30-pin/MicroUSB 4-in-1 USB cable adapter last time it made the rounds (for slightly more money :\ ) and it is again available on Tanga.com for $7.

Tanga took about 2-3 days on delivery and it comes in a sealed plastic package similar to Apple’s own products. Taking it out of the plastic, it feels a little lighter than Apple’s own cables which is especially noteworthy since this is a ‘three-headed’ monster’ cable. Each lead is under a foot long which can be an advantage or disadvantage, depending on your needs. I like short cables personally.

How well does it work? Plug and play! All three cables ‘just work’ as they say, on Apple/Android phones. Although on the surface, this looks similar to Apple’s cables, the fit isn’t quite as good. I found plugging in 30-pin and lightning cables were a little snug the first time around.  MicroUSB fits like any other adapter I’ve used. At only $7, this clearly isn’t an Apple MFI-certified cable.

It isn’t all glory however. Because you are limited to the power output of your USB Port, you can’t plug in just any device to this cable and get three separate charges. Plug in an iPad (even a mini) and you can only charge two devices (though USB synching doesn’t seem to be affected). Plugging in a third will knock out power to all three and I’m pretty sure you aren’t going to get the quick charge your iPad deserves.  I however use it with lots of success to charge my iPad and my Zagg (big sale today btw!)/Logitech keyboards simultaneously from 1 USB port. It is also great for cars where you have a limited amount of ports.

The 4-in-1 USB to Lightning/30-pin/Micro-USB cable is available for $3.99+$2.99 shipping today only from Tanga.com [direct link]

AT&T explains its new 61 cent/month administrative fee policy

Site default logo image

administrative-fee.
Thanks reader Kory for screenshot

AT&T started this month charging an administrative fee of $.61/month/user for its mobile customers in addition to its current fees. While the fee may be small, as the Verge notes it adds ‘up to hundreds of millions of dollars’ over 24 month contracts and millions of customers. What gives?  An AT&T spokesperson told us:

Consistent with similar fees charged by other carriers, the monthly fee of 61 cents per line will help cover certain expenses, such as interconnection and cell site rents and maintenance

The fee applies to consumer mobility lines as well as IRU lines –  the kind of business lines where the employee pays the bill directly.

AT&T isn’t alone in this endeavor. Verizon charges admin fees of $0.91 and Sprint charges $1.99.  (Plus more for regulatory fees.)  T-Mobile’s combined regulatory programs fee is $1.61.  On this basis, AT&T’s is still the lowest of all carriers.  It still sucks though. “expenses, such as interconnection and cell site rents and maintenance” seems like it should be part of the current fees and that fee is easier to raise because it isn’t part of the publicized rate plan.

Update: TheTechBlock notes that you may be able to cancel your plan because of this fee. A nice way to slip out of your subsidized plan?

Rumor: Cheaper iPhone is being tested in a plethora of colors, will be produced July-September

Site default logo image

Credit: Ferry Passchier

Japanese Blog Macotakara purports to have some interesting details on the plastic ‘low cost’ iPhone Apple is expected to release later this year. The site says that runs of colors Navy, Gold Orange, White and Gray are in one run of the device and  White, Pink, Green, Blue and Yellow-orange are in another. There is no black model according to the report.

Theoretically these models will be tested in small numbers and some might not make the cut, if the report is to be believed.

Their source also indicates that the cheaper iPhone will be produced 1,000 units for field test from June, and will be produced during July-September for shipping. If you want to see what these colors might look like head over to our mockup gallery where we tried to cover all of the bases.

Jon Stewart rubs Tim Cook’s Senate testimony the wrong way [Video]

Site default logo image

http://www.youtube.com/watch?feature=player_embedded&v=VLIf0m5CNXQ

You can’t help but laugh at Stewart’s ribbing of the senators’ questioning, but it is pretty clear Apple is pushing for simplicity and is only jumping through the loopholes because they are there. Tim Cook appears very genuine in his hopes for a more simple, fair tax code.

In other news, Apple is doubling its lobbying spending.

The company spent about $2 million on lobbying last year, up from $180,000 in 1999, records show. This year it is on pace to nearly double last year’s figure.

Apple’s lobbying expenditures still pale in comparison with those of Microsoft Corp., which spent $8.1 million in 2012, and Google, which spent $16.5 million, records show.

Next Mac ‘Gigabit Wifi’ spotted? Broadcom BCM94360CD PCI-E mini WLAN+Bluetooth card in the wild

Site default logo image

There have been plenty of hints over the past months that indicate that Apple’s incoming next round of MacBook Air/Pros would contain 802.11AC Gigabit wifi chips, not the least of which was code we found referencing ‘802.11AC‘ in 10.8.4 Betas.

TonyMacx86, found some interesting parts on Chinese VR-Zone today that could be the next 802.11AC boards in Macs, widely expected to be announced at WWDC next month. The Broadcom BCM94360CD PCI-E mini custom combo WLAN+Bluetooth card supports IEEE 802.11ac, the next standard in wireless computer networking. Interestingly, it also looks like it may fit in current iMacs/MacBooks which could mean aftermarket updates could be possible.

This compares to the current iMac cards via iFixit below:

Yahoo’s new Flickr now comes with redesigned Homepage/UI, 1TB of free storage

Site default logo image

Screen Shot 2013-05-20 at 5.29.34 PM

All of a sudden Flickr is back. Yahoo CEO Marissa Mayer’s Tumblr (that was quick!) post on the matter:

Photos tell the stories — stories we’re inspired to relive, share with our friends, or capture simply to express ourselves. Collecting these moments is a part of our everyday. Since 2005, Flickr has become synonymous with inspiring imagery. Today, we’re thrilled to take Flickr even further with a beautiful, completely re-imagined experience that puts photos front and center. When it comes to photography, technology and its limits shouldn’t hinder the experience. So we’re also giving our Flickr users one terabyte of space — for free. That’s enough for a lifetime of photos — more than 500,000 original, full-resolution, pixel-perfect, brilliant photos. Flickr users will never have to worry about running out of space.

1TB is “I no longer have to think about where to store photos,” and full res quality means no compromise. Oh, and we’ve heard there will be some even bigger things coming up from Yahoo/Flickr for iOS users next month. Flickr is currently integrated into OS X and Apple TV software.

Apple CEO Tim Cook faces the US Senate, bipartisan senators plan to question Apple’s creativity in tax avoidance

Apple has already made its planned remarks before a Senate committee on Tax Reform known.

Here’s what the other side has to say via Michigan’s Carl Levin (Democrat) on the senator’s view of Apple’s tax avoidance strategy:

“Apple wasn’t satisfied with shifting its profits to a low-tax offshore tax haven. Apple sought the Holy Grail of tax avoidance. It has created offshore entities holding tens of billions of dollars, while claiming to be tax resident nowhere. We intend to highlight that gimmick and other Apple offshore tax avoidance tactics so that American working families who pay their share of taxes understand how offshore tax loopholes raise their tax burden, add to the federal deficit and ought to be closed.”

Republican Senator John McCain adds:

“Apple claims to be the largest U.S. corporate taxpayer, but by sheer size and scale, it is also among America’s largest tax avoiders. A company that found remarkable success by harnessing American ingenuity and the opportunities afforded by the U.S. economy should not be shifting its profits overseas to avoid the payment of U.S. tax, purposefully depriving the American people of revenue. It is important to understand Apple’s byzantine tax structure so that we can effectively close the loopholes utilized by many U.S. multinational companies, particularly in this era of sequestration.I have long advocated for modernizing our broken and uncompetitive tax code, but that cannot and must not be an excuse for turning a blind eye to the highly questionable tax strategies that corporations like Apple use to avoid paying taxes in America. The proper place for the bulk of Apple’s creative energy ought to go into its innovative products and services, not in its tax department.”

Apple Chief Executive Officer Tim Cook, Chief Financial Officer Peter Oppenheimer, and Tax Operations Head Phillip Bullock will be on hand giving testimony.  Check back tomorrow for the blow by blow.

Mophie introduces 2100mAh iPhone 5 Juice Pack Plus cases

Disney’s ABC to livestream all programming to iOS devices starting this week

Site default logo image

mzl.efqostua.480x480-75 mzl.duqzrtmz.480x480-75

Big news from the New York Times this evening. ABC, a subsidiary of the Walt Disney Company,  will begin streaming live content to iOS devices later this week in Philadelphia and New York City using a new button on their app called ‘live’. Users will be able to live stream all the programming from ABC’s local stations there, ‘the first time that any major broadcaster has turned on such a technology.’

For the first six weeks the service will be free to anyone with an iOS device according to GigaOM. Before you go grabbing the scissors to cut that cable cord, be warned that the live stream will eventually be available only to paying subscribers of cable and satellite providers, even though the stations’ signals are available free over the public airwaves.

ABC, a unit of the Walt Disney Company, said the live stream would be available in the other six cities where it owns stations sometime this summer. It is also in talks with the companies that own ABC’s more than 200 affiliates to make the “live” button work in their markets.

Also, not all shows have beencleared for streaming so there might be some discrepancies between the live feeds and the stream. The news comes as a service called Aereo (which we’ve reviewed) is place shifting broadcast signals to the internet, making live channels available to portable device owners.

Times have changed: No iTunes water in Windows 8 Hell for Microsoft Metro tablet users

Site default logo image

[youtube=http://www.youtube.com/watch?v=u4AXaFlIFQA&start=29]

“It’s like giving a glass of ice water to somebody in hell”

That’s what Steve Jobs said of iTunes for Windows when asked why Apple made its software for competing Microsoft users in 2007.

But times have changed. Apple continues to make/support iTunes for Windows desktop computing environments, but it doesn’t need Microsoft’s outlier tablet users who now represent the third largest share of tablet OS behind iOS and Android (by the way, don’t expect iTunes for Android any time soon either).

In fact, the iTunes ecosystem is a competitive advantage as Apple sells its iOS tablets, smartphones and TVs against Android and now Windows 8 devices. Where Windows dominated the userbase in the early 2000s, Apple now is the leader in the current ecosystem race.

That’s why it comes as no surprise that Microsoft’s Windows division CFO Tami Reller is telling folks not to expect a Windows 8 ‘Metro’ iTunes app:

“You shouldn’t expect an iTunes app on Windows 8 any time soon,” said Tami Reller, chief financial officer of Microsoft’s Windows division. “ITunes is in high demand. The welcome mat has been laid out. It’s not for lack of trying.”

It should be noted that Microsoft has been dragging its feet in delivering the once ubiquitous Office Suite of applications for iOS which is now letting competitors (Like Pages/Numbers/Keynote and Google Apps) thrive on the now dominant iOS and Android touch platforms.

AT&T launches AIO Wireless MVNO with iPhone 5 plans at $55 to $70/month

Site default logo image

Screen Shot 2013-05-09 at 10.09.43 AM.

As we reported last week, AT&T today launched its new pre-paid wireless MVNO called Aio Wireless with the iPhone 5 on offer, front and center. Currently, the service is only available in Houston, Orlando and Tampa but it is expected to roll out nationally over the coming months.

The company will offer 4 plans: Aio Basic, Smart and Pro phone plans at $35-40 for 250MB, $55 for 2GB and $70/month for 7GB data respectively. Each plan will shift to lower speed data after data is used up and also offers unlimited calls and text on AT&T’s network. They will also offer a tablet plan that starts at $15/month for 250MB.

The MVNO will carry Android, Windows and Apple smartphones including iPhone 4S for $499 and iPhone 5 for $649 without subsidy. They also cap 4G data at 4Mb/s so LTE speeds shouldn’t be expected.

Clearly this, as well as Verizon’s upcoming MVNO-like service, will address the competition from T-Mobile and other pre-paid carriers.

Apple’s product photographer interviewed

We remember Peter Belanger from pioneering iPhone photography for magazine covers in 2010. Turns out he is now doing regular photoshoots for Apple and often uses a Canon 5D Mark III with a the 24-70mm lens. He gave the Verge some insight on what its like to use the bigger camera for the most demanding clients in the world.

Belanger is the man behind some of Apple’s most iconic product images, a San Francisco-based product photographer at the top of his field. Apple is but one of his clients — he’s done work for everyone from eBay and Nike to Pixar and Square — and we sat down with Peter to talk about his work, his background, and some very, very expensive gear.
